Terms and Conditions – Tjin’s Toko

1. Introduction

These Terms and Conditions apply to the use of the website of Tjin’s Toko and to all orders placed through the webshop.

By placing an order, the customer agrees to these terms. We recommend that you read these terms carefully and save them for future reference.

2. Definitions

Tjin’s Toko

Tjin’s Toko B.V., established in Amsterdam and registered with the Chamber of Commerce under number 82416133.

Website

The website of Tjin’s Toko accessible via www.tjinstoko.nl and its subdomains.

Customer

The natural person entering into an agreement with Tjin’s Toko who is not acting in the course of a profession or business.

Agreement

The agreement between Tjin’s Toko and the customer regarding the purchase of products through the website.

3. Applicability

These terms apply to all offers, orders and agreements of Tjin’s Toko.

Any deviations are only valid if agreed in writing.

If any provision proves invalid, the remaining provisions remain in force.

4. Prices and information

All prices on the website include VAT.

Shipping costs are displayed separately during checkout.

Obvious errors or pricing mistakes are not binding on Tjin’s Toko.

Product images may slightly differ from reality.

5. Formation of the agreement

The agreement is concluded when the customer places an order and Tjin’s Toko confirms it.

The customer receives an order confirmation by email.

Tjin’s Toko may refuse orders in case of incorrect information or suspected misuse.

6. Delivery

Orders are shipped as soon as possible.

The maximum statutory delivery period is 30 days, unless agreed otherwise.

Delivery takes place at the address or pickup point specified by the customer.

Risk transfers to the customer once the order has been delivered.

7. International shipping (EU)

Tjin’s Toko ships exclusively within the European Union.

Within the EU no import duties or customs charges apply.

Delivery times may vary depending on the destination country and carrier.

The customer is responsible for entering the correct delivery address.

8. Uncollected parcels

If an order is delivered to a pickup point and not collected within the specified period, the parcel will automatically be returned to Tjin’s Toko.

In this case:

the purchase price of the products will be refunded;
shipping and return costs may be deducted from the refund.

If the customer still wishes to receive the order, it can be shipped again after payment of new shipping costs.

9. Sale of alcohol

Alcoholic products are only sold to persons 18 years or older.

By placing an order the customer confirms that they meet the legal age requirement.

If age verification is required upon delivery and the recipient cannot prove their age, delivery may be refused.

Return costs may be charged in such cases.

10. Right of withdrawal

The customer has the right to cancel the agreement within 14 days after receiving the product without giving a reason.

The customer must inform Tjin’s Toko within this period.

The product must then be returned within 14 days.

Return shipping costs are at the customer’s expense.

Tjin’s Toko will refund the purchase amount including standard shipping costs within 14 days after receiving the returned product.

11. Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

products that spoil quickly;
opened food products;
sealed products that have been opened;
custom-made products;
used gift vouchers.

12. Business orders and resale

Tjin’s Toko sells products primarily as a retailer to consumers.

Business purchases are only allowed for internal use within the customer’s business.

Products may not be used for:

resale
distribution
repackaging
private label products
use as ingredients in production processes

unless agreed in writing with Tjin’s Toko.

Tjin’s Toko acts as a retailer and not as a manufacturer or importer of the products offered.

13. Product information

Product information is provided in accordance with the EU Food Information to Consumers Regulation (EU 1169/2011).

The available information is limited to consumer information such as:

ingredients
allergens
nutritional values
net quantity
origin where legally required

Tjin’s Toko generally does not possess detailed product specifications, technical datasheets, HACCP documentation or traceability documents.

Business customers requiring such information must obtain it directly from the manufacturer or importer.

14. Product information and labels

Tjin’s Toko aims to keep product information on the website up to date.

Manufacturers may change ingredients, recipes or packaging without prior notice.

The information on the product label of the delivered product is always leading.

Customers are advised to check the label carefully in case of allergies or food intolerances.

15. Warranty and conformity

Tjin’s Toko guarantees that products conform to the agreement.

If a product is defective or damaged this must be reported within a reasonable time.

If a complaint is justified, Tjin’s Toko will repair, replace or refund the product.

16. Shelf life of food products

Food products have a limited shelf life.

Tjin’s Toko aims to supply products with a minimum remaining shelf life of one month, unless stated otherwise.

17. Complaints procedure

Complaints can be submitted via email, phone or in writing.

Tjin’s Toko will respond within 14 days.

18. Liability

Tjin’s Toko is not liable for indirect or consequential damages.

Liability is limited to the purchase price of the product.

This limitation does not apply in cases of intent or gross negligence.

19. Personal data

Personal data is processed in accordance with the privacy policy of Tjin’s Toko.

20. Applicable law

All agreements are governed by Dutch law.

Disputes shall be submitted to the competent court in the Netherlands.
